Welcome to Fiiera Intelligence Inc. and its website and mobile application (referred to as a “Application”). The terms "Fiiera," "we," "us" and "our" refer to Fiiera Intelligence Inc. (together with its subsidiaries and affiliates). These Terms of Use (the “Terms”) govern your use of the Application and your use of information obtained through our Application, including information, software, artwork, text, video, audio, pictures, content, trademarks, trade dress and other intellectual property owned by Fiiera or our licensors and made available to you through the Application (collectively, "Fiiera Content"). Additional terms and conditions may apply to products and services offered on our Application. By using our Application, you agree to be bound by the Terms set forth herein. If you do not agree to be bound by these Terms, please do not use our Application.
By using our Application, you affirm that you are either: i) of legal age to enter into these Terms; or, ii) at least 13 years of age and are using the Application under the supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf. WE DO NOT ALLOW INDIVIDUALS WHO WE KNOW ARE UNDER 13 TO PARTICIPATE IN OUR APPLICATION.
If you create a user account, you are solely responsible for maintaining the confidentiality of username and password and restricting access to your computer or device. Fiiera is not responsible for any losses arising out of the unauthorized use of your account.

You may choose to register for an account on our Application. You are not required to create an account to browse our Application. When you register, you will be asked for Personal Information such as your name, address, phone number, email address, and will be required to select a username and password. You may also provide information regarding your interests and project lists. This information may be used to help make your online shopping quicker and easier by pre-filling certain parts of your shopping information. In addition, your information may be used to personalize digital contract or deliver marketing communications and advertising. In the course of using the Application, you may be able to provide comments, feedback and reviews to Fiiera and other users of the Application or post media, including photos and videos to the Application (collectively, “User Content”). You agree that User Content may be visible to certain other users or the general public and such User Content shall not be considered to be private, proprietary or confidential. You hereby grant Fiiera a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sub-licensable and transferable right to copy, adapt, create derivative works, distribute, reproduce, modify, publicly display or otherwise fully exploit your User Content (including all related intellectual property rights) in connection with the Application and Fiiera's (and its successors' and assigns') business, including without limitation for promoting and redistributing part or all of the Application, associated services and User Content (and derivative works thereof) in any media formats and through any media channels; however, Fiiera will only share your personally identifiable information in accordance with our Privacy Policy. You agree that your User Content may appear on other Fiiera websites and applications other than the Application through which you submitted your User Content. You represent that you have all necessary rights and consents to upload photographs and images submitted through the services. You grant Fiiera a limited license to use such User Content for providing and improving the services. Body measurement information, recommendation profiles and information collected through connected email accounts will be retained only for as long as reasonably necessary to provide the services, comply with legal obligations, resolve disputes and enforce our agreements. Users may request deletion of such information, subject to legal, regulatory, contractual and technical limitations.
You understand that all information publicly posted or privately transmitted through the Application is the sole responsibility of the person from which such content originated and that Fiiera will not be liable for any errors or omissions in any content. You understand that Fiiera cannot guarantee the identity of any other users with whom you may interact in the course of using the Application. Additionally, Fiiera cannot guarantee the authenticity of any data, which users or merchants may provide about themselves. You acknowledge that all User Content and other content accessed by you while using the Application is at your own risk and you will be solely responsible for any damage or loss to any party resulting therefrom. Under no circumstances will Fiiera be liable in any way for any User Content, including, but not limited to, any errors or omissions in any User Content, or any loss or damage of any kind incurred in connection with use of or exposure to any User Content posted, emailed, accessed, transmitted, or otherwise made available via the Application.
You, not Fiiera, remain solely responsible for all User Content that you upload, post, email, transmit, or otherwise disseminate using, or in connection with, the Application, and you warrant that you possess all rights necessary to provide such User Content to Fiiera and to grant Fiiera the rights to use such information in connection with the Application and as otherwise provided herein. You are responsible for all of your activity in connection with the Application.
Although we have no and assume no obligation to monitor activities on the Application or evaluate User Content, we reserve the right at any time to (i) monitor your use of the Application and User Content, and (ii) terminate or suspend your use of some or all of the Application or Fiiera Content if you engage in activities that we conclude, in our discretion, breach these Terms or our Privacy Policy. Fiiera reserves the right to remove any User Content from the Application at any time, for any reason (including, but not limited to, upon receipt of claims or allegations from third parties or authorities relating to such User Content or if Fiiera is concerned that you may have breached our Terms), or for no reason at all.
You should also understand that our Terms are based in many instances on principles of applicable law. Violations of our Terms accordingly may expose you to criminal charges, and civil liability to harmed parties for compensatory damages and attorney's fees. Fiiera reserves the right at all times to disclose information it deems necessary to satisfy any applicable law, regulation, legal process or governmental request, consistent with our Privacy Policy.
Use of any Application and Fiiera Content is subject to our Privacy Policy (“Privacy Policy”) which is incorporated herein. Please review the Privacy Policy to learn more on how we may collect and use your information.
The Fiiera Content on our Application is the subject of copyright protection and is the proprietary property of Fiiera or its licensees. Copyright entitles the owner to the exclusive right to copy and reproduce the materials. Copying or reproducing Fiiera Content may infringe the copyright. In accordance with the Terms of this Agreement, you are permitted only to download, display, print or reproduce the Fiiera Content in unaltered form for personal, non-commercial use, research or study. Fiiera and our licensors retain all rights with respect to the Application and Fiiera Content except those expressly granted to you in these Terms. You may not (i) access, view, modify or otherwise use any portion of our Application not made expressly accessible to you, or (ii) modify, copy, distribute or otherwise use the Application or Fiiera Content without our express permission. Requests for authorization to use the Fiiera Content contained on this Application for any other purpose should be directed in writing to the contact information provided below. No copyright is claimed on materials, formats or styles, which originated from outside sources when it can be conclusively demonstrated or apparent that the copyright was originated by some other person, corporation or entity. The Fiiera name, logo and associated design, and those of any affiliated company, are registered trademarks owned by Fiiera. Fiiera’s name, logos, and designs may not be used in any manner inconsistent with Fiiera’s ownership rights thereto. Third party trademarks found on our Application or Fiiera Content are the property of their respective owners. Any other techniques, business information, technical information, specifications, and other such "intellectual property" that may be found on or disclosed within our Application is for informational purposes only and may not be sold or distributed for commercial gain.
By confirming your purchase at the end of the checkout process, you agree to accept and pay for the products, including all shipping charges and applicable taxes. You represent and warrant that you have the right to use any credit or debit card that you provide to us. By providing payment card information to us, you authorize us to store and use the card as a payment method for purchases made through our Application. All billing information you provide to us must be truthful and accurate. Providing any untruthful or inaccurate information is a breach of these Terms and may result in cancellation of your order.
Fiiera’s acknowledgment of an order signifies that we received your order request, but it does not constitute acceptance of your order or a promise to fulfill your order. We cannot confirm the price or availability of an item until after your order is placed. You will not be charged for most orders until the order has been accepted or shipped. We may request a pre-authorization for some orders placed online with a credit or debit card. This pre-authorization will not be billed to you; however, your card issuer may hold this amount for a short period. Your card issuer determines the length of time the pre-authorization is held. Prior to accepting an order we may also request additional information from you. Verification of information may be required prior to the acknowledgment or completion of any purchase. We reserve the right to refuse or cancel an order for any reason including limitations on quantities available for purchase, inaccuracies, or errors in product or pricing information, or problems identified by our credit and fraud avoidance department. We also reserve the right, at our sole discretion, to prohibit sales to dealers or resellers. For purposes of these Terms, “reselling” will be defined as purchasing or intending to purchase any product(s) from Fiiera for the purpose of engaging in a commercial sale of the same product(s) to a third party. If your order is canceled after your credit or debit card has been charged, we will issue a credit to the same credit or debit card in the amount of the charge. We will attempt to contact you if all or any portion of your order is canceled or if additional information is required to accept your order.
Products will be shipped to an address designated by you, if applicable, so long as such address is complete and complies with the shipping restrictions contained on our Application. Some products have restricted delivery within the United States and/or Canada. All products purchased through our Application are made pursuant to a shipping contract, and, as a result, risk of loss and title for products pass to you upon delivery of the products to the carrier.
We make our best efforts to provide comprehensive, complete and current information on our Application. It is possible, however, that there may be additional information about one or more products that is not posted to a website. Product dimensions in our catalog and installation sheets are nominal and are provided for the convenience of our customers. We reserve the right to make changes from time to time, without notice, which may change the dimensions or information shown. The information on our Application may use terms that have technical meanings that may be different from their ordinary meanings and require specialist knowledge and expertise to understand properly and use effectively. Typographical or pictorial errors within our Application which are brought to our attention will be corrected in subsequent updates. Fiiera's sizing, fit, recommendation and measurement tools are intended solely as informational aids and do not guarantee product fit, comfort, appearance, suitability or customer satisfaction. Clothing recommendations generated through the services are estimates only and may not accurately predict fit, comfort, sizing or product performance. Measurements generated using photographs, artificial intelligence or other automated tools may vary from actual body dimensions. Users are responsible for confirming measurements before purchasing products. Without limiting the foregoing, Fiiera shall not be liable for incorrect sizing recommendations, purchasing decisions, fit dissatisfaction, return costs, tailoring expenses or other losses arising from recommendations generated through the services.
Fiiera is not the seller of products offered by third parties unless expressly identified otherwise. Any transaction between a user and a retailer, brand or other third party is solely between those parties. Fiiera makes no representations regarding the quality, availability, legality, safety or suitability of products offered by third-party merchants.
Fiiera may receive referral fees, commissions or other compensation from certain partners when users purchase products through links, referrals or recommendations.
By connecting an email account, you authorize Fiiera to access and process information contained in that account for the purposes described in the Privacy Policy.
Payment card information is processed by third-party payment providers that maintain industry-standard security controls, including PCI-DSS compliance. Some of the information contained in this Application is provided to us by third parties. It is not possible for Fiiera to check exhaustively the accuracy of all information provided by third parties. Although we may provide links to other websites or applications ("Linked Applications") as a matter of convenience for our users, we have no control over these Linked Applications, and we do not necessarily share their viewpoints and cannot guarantee the accuracy or authenticity of the information within those websites or applications. Use these Linked Applications at your own risk. The presence of a Linked Applications on the Application does not and should not be taken as implying an endorsement or approval of the content of the Linked Applications by Fiiera, the activities of the organizations and businesses responsible for those websites or applications, or any policies associated with such websites or applications whether or not those policies are published. Under no circumstances is Fiiera responsible or liable for any privacy, intellectual property, or other policy of a Linked Applications provided on our Application.
You agree that Fiiera shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings with third parties. If there is a dispute between participants on this site, or between users and any third party, you understand and agree that Fiiera is under no obligation to become involved. In the event that you have a dispute with one or more other users, you hereby release Fiiera, its officers, employees, agents, and successors in rights from claims, demands, and damages (actual and consequential) of every kind or nature, known or unknown, suspected or unsuspected, disclosed or undisclosed, arising out of or in any way related to such disputes. If you are a California resident, you shall and hereby do waive California Civil Code Section 1542, which says: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party."
In addition to these Terms, any sweepstakes, contests, raffles or similar promotions (collectively, "Promotions") made available through any our Application may be governed by specific rules that are separate from or supplement these Terms. Fiiera urges you to review any specific rules applicable to a particular Promotion, which will be linked from such Promotion, and to review our Privacy Policy, which, in addition to these Terms, governs any information you submit in connection with such Promotion. To the extent that the terms and conditions of such Promotion rules conflict with these Terms, the terms and conditions of such Promotion rules shall control.
THE FIIERA APPLICATION AND ALL FIIERA CONTENT, MATERIALS, AND INFORMATION CONTRAINED ON, OR OBTAINED FROM OUR APPLICATION, ARE DISTRIBUTED AND TRANSMITTED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. FIIERA DOES NOT WARRANT THAT YOUR USE OF THE APPLICATION WILL BE UNINTERRUPTED, ERROR FREE OR SECURE; THAT DEFECTS WILL BE CORRECTED; OR THAT THE APPLICATION OR THE SERVER(S) ON WHICH THE APPLICATION IS HOSTED ARE FREE OF VIRUSES, BUGS OR OTHER HARMFUL COMPONENTS. YOU ASSUME FULL RESPONSIBILITY FOR YOUR USE OF THE FIIERA APPLICATION AND AGREE THAT ANY INFORMATION YOU SEND OR RECEIVE DURING YOUR USE OF THE FIIERA SITES MAY NOT BE SECURE AND MAY BE INTERCEPTED OR OTHERWISE ACCESSED BY UNAUTHORIZED PARTIES. TO THE FULLEST EXTENT PROVIDED BY APPLICABLE LAW, FIIERA WILL NOT BE LIABLE FOR ANY DAMAGES IN EXCESS OF THE FEES PAID BY YOU IN CONNECTION WITH YOUR USE OF THE FIIERA APPLICATION DURING THE SIX (6) MONTH PERIOD PRECEDING THE DATE ON WHICH THE CLAIM AROSE.
You agree to defend, indemnify and hold Fiiera and its subsidiaries, affiliates, officers, directors, agents and employees harmless from any liability to third parties, including reasonable attorneys' fees, arising from or related to your breach of these Terms.
These Terms shall be governed in all respects by the laws of the Province of Ontario and the City of Toronto without giving effect to its conflicts of law provisions.
These Terms shall remain in full force and effect while you use the Application, Fiiera Content, and associated services. You may terminate your use of the Application, Fiiera Content, and services at any time. Fiiera may terminate or suspend your access to the Application or services or your account at any time, for any reason, and without warning, which may result in the forfeiture and destruction of all information associated with your account. Fiiera may also terminate or suspend any and all services and access to the Application immediately, without prior notice or liability, if you breach any of the terms or conditions of these Terms. Upon termination of your account, your right to use the services, access the Application, and any Fiiera Content will immediately cease. All provisions of these Terms which, by their nature, should survive termination, shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, and limitations of liability.
These Terms may be updated periodically and without prior notice to you to reflect changes in our practices or relevant laws. We will notify you of any material changes to our Terms by posting an updated copy on our Application. It is your responsibility to review the Terms for updates and changes. The “Last Updated” legend below indicates when our Terms were last changed. Your continued use after we post changes constitutes your acceptance of the update Terms.
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. Headings are for reference purposes only and in no way define, limit, construe, or describe the scope or extent of such section. Fiiera's failure to act with respect to a breach by you or others does not waive its right to act with respect to subsequent or similar breaches. These Terms set forth the entire understanding and agreement between Fiiera and you with respect to the subject matter hereof and supersede any prior or contemporaneous understanding, whether written or oral.

Three structural changes are happening simultaneously, at Google, Meta, and across the affiliate commerce landscape. Each one reduces the reach of organic content and the value of the cookie-based affiliate model that most creators depend on.
